Service Level Agreement – Safetymen Ltd

 

Safetymen – CITB Site Safety Plus Training

This Service Agreement (“Agreement”) is made between:

Safetymen (“Provider”), a CITB‑approved Health & Safety Training Organisation, and
Clients.

Together, the Provider and Client are referred to as “the Parties”.

 

1. Scope of Services

Safetymen agrees to deliver CITB Site Safety Plus (SSP) training courses, which may include:

  • CITB Health & Safety Awareness (HSA)
  • CITB SSSTS / SSSTS‑Refresher
  • CITB SMSTS / SMSTS‑Refresher

A detailed description of the specific course(s), dates, and locations will be provided in the Booking Confirmation.

 

2. Responsibilities of Safetymen

Safetymen will:

  • Deliver training in accordance with CITB Site Safety Plus Scheme Rules
  • Provide qualified, CITB‑approved trainers
  • Supply all required course materials
  • Conduct mandatory identity checks and attendance monitoring
  • Administer assessments, exams, and paperwork as required by CITB
  • Submit results to CITB for certification
  • Maintain appropriate insurance and quality assurance standards
  • Provide a safe and suitable learning environment
  •  

3. Responsibilities of the Client

The Client agrees to:

  • Ensure delegates meet any CITB entry requirements
  • Provide accurate delegate information (full legal name, DOB, CITB number if known)
  • Ensure delegates bring valid photographic ID as required by CITB
  • Ensure delegates attend all sessions in full — Safetymen does not permit late arrivals or early departures
  • Provide a safe and suitable training environment when training is delivered on Client premises
  • Notify Safetymen of any learning needs or reasonable adjustments in advance
  • Ensure delegates comply with course rules, assessments, and trainer instructions

 

4. Fees and Payment Terms

 

  • Course fees will be outlined in the Booking Confirmation.
  • Payment is due 14 days before course date (for account customers) or at time of booking for all others.
  • CITB levy grants remain the responsibility of the Client; Safetymen does not guarantee grant eligibility.
  • Certificates may be withheld until payment is received in full.
  • Late payments may incur interest at 2.5% per calendar month

 

5. Cancellations, Rescheduling, and Non‑Attendance

By the Client

Cancellations are required only in writing or email and apply from date received. Bank Holidays etc. are not included on time limits:

·         For cancellations made 21 working days or more before the course start date, full refund of course fee

·         For cancellations made more than 14 working days, but less than 21 working days, before the course start date:    50% refund of course fee on cancellation or £50.00 administration fee on transfer to next available course.

·         For cancellation made less than 14 working days before the course start date or non-arrival: Full fee payable.

·         Delegate substitutions may be accepted if the replacement meets CITB requirements and ID checks

·         Non‑attendance or failure to meet CITB attendance rules: full fee payable

 

By Safetymen

Safetymen may cancel or reschedule training due to low numbers, trainer illness, or other unforeseen circumstances. The Client may choose:

  • A full refund, or
  • Transfer to another date at no additional cost

Safetymen is not liable for indirect or consequential losses arising from cancellation or rescheduling.

 

6. CITB Attendance & Assessment Requirements

The Client acknowledges that:

  • CITB requires 100% attendance for all courses
  • Delegates must complete all assessments, exercises, and exams
  • Failure to meet CITB standards may result in a fail with no refund
  • CITB may audit courses, paperwork, and delegate records
  • Safetymen must comply with CITB quality assurance processes

 

 

7. Health & Safety

Both Parties agree to comply with relevant health and safety legislation.
Where training is delivered on Client premises, the Client must provide:

  • A safe training room
  • Welfare facilities
  • Any site‑specific risk information
  • Emergency arrangements

 

8. Data Protection

Safetymen will process personal data in accordance with applicable data protection laws.
Delegate information may be shared with CITB for certification, audits, and compliance.

 

9. Intellectual Property

All training materials remain the intellectual property of Safetymen or CITB.
The Client may not reproduce, distribute, or modify materials without written permission.

 

10. Liability

Safetymen’s liability is limited to the value of the services provided under this Agreement.
Safetymen is not liable for:

  • Loss of profit
  • Loss of business
  • Indirect or consequential damages

Nothing in this Agreement limits liability for death or personal injury caused by negligence.

 

11. Termination

Either Party may terminate this Agreement with written notice if the other Party:

  • Commits a material breach and fails to remedy it within14 days, or
  • Becomes insolvent or ceases trading

The Client remains responsible for payment of any completed or in‑progress training.

 

12. Governing Law

This Agreement is governed by the laws of England and Wales, unless otherwise agreed.

 

13. Acceptance

By booking CITB training with Safetymen, the Client agrees to the terms of this Service Agreement.
